These Terms and Conditions ("Terms") govern your use of the Meal Ordering Portal (the "Portal") operated by
Wilmar Kitchen Concepts Pte Ltd ("we", "us", or "our") for school canteen services. By registering for or using
the Portal, you agree to be legally bound by these Terms.
1. Purpose of the Portal
The Portal enables the following:
- Students, parents, and school staff ("Users") may pre-order meals from school canteen vendors for collection or distribution within the school premises.
We act as the following:
- The canteen operator, Portal administrator, and food provider.
2. User Eligibility
2.1 Students
- Students under 18 may use the Portal only with the consent of a parent or guardian.
- The parent or guardian is responsible for orders placed, payments made, and compliance with these Terms.
2.2 Parents and Guardians
- Parents and guardians must ensure that all student details, including name, class, and dietary restrictions, are accurate and up to date.
- They are responsible for monitoring the student's use of the Portal and any orders placed.
2.3 School Staff
- School staff may register and use the Portal as consumers.
3. Account Registration and Accuracy
You must provide accurate, complete, and current information when registering and using the Portal, and you must promptly update any changes to your account or student details.
4. Pre-Order Process
4.1 Order Timing
- Orders must be placed before the specified cut-off time.
- Late orders may not be accepted.
4.2 Order Confirmation
- An order is confirmed only when payment has been successfully processed, and a confirmation is issued through the Portal.
4.3 Meal Preparation
- Meals are prepared in advance for scheduled collection or school distribution.
- Some ingredients, like vegetables, may vary based on availability. We may substitute them or make reasonable changes with items of similar type and quality.
5. Collection and Distribution
Meals shall be collected at designated canteen counters or distributed through school-approved processes.
We may adjust the distribution process when there is school closure, school activities / excursion, emergency situations, public health advisories, or government directives.
Users agree to the following:
- Meals must be collected and consumed within the assigned time window.
- Uncollected meals may be discarded for food safety reasons.
6. Payment Terms
All transactions on the Portal must be made through the Portal e-wallet system ("E-Wallet"), which is the only permitted payment method for food and beverage purchases.
6.1 E-Wallet Use
- You must maintain a sufficient E-Wallet balance to place orders.
- Payment for each order will be automatically deducted from your E-Wallet once the order is confirmed.
6.2 E-Wallet Top-Ups
- You may top up your E-Wallet using approved methods, including PayNow as the primary method and any other methods that may be introduced from time to time.
- All top-up transactions are final and non-refundable, except where required by law.
6.3 Pricing
- All prices are stated in Singapore dollars (SGD), are inclusive of GST, and include any BCRS deposit where applicable.
- We may adjust prices from time to time, with notice where required.
6.4 E-Wallet Withdrawal
- You may request a withdrawal of your available E-Wallet balance by sending an email request to wil-sams-parentsupport@sg.wilmar-intl.com and providing the student or consumer name, school, class, registered account number, and bank account details or PayNow registered number.
- We may verify the identity of the requester and may reject or delay any withdrawal request if the information provided is incomplete or inconsistent.
- Withdrawal requests are subject to administrative processing and may take up to thirty (30) days from the date we receive a complete and valid request.
- Once the withdrawal process has started, your E-Wallet will be frozen from top-up or payment.
6.5 Low Balance and Account Closure
If the E-Wallet balance falls below SGD 5.00 and the account remains inactive for a continuous period of six (6) months, the Portal reserves the right to:
- Automatically suspend and close the account; and
- Charge an admin fee of SGD 2 per month, until the E-Wallet has no balance, without further notice.
6.6 Authorisation
- By using the Portal, you authorise us to deduct payments, fees, and charges from your E-Wallet and to process transactions in accordance with these Terms.
7. Cancellation and Refund Policy
- Orders cannot be cancelled after the cut-off time.
- A refund may be granted only if a medical certificate (MC) is submitted within three (3) days of the collection date, or if the order cannot be fulfilled due to operational issues.
- No refund will be given for failure to collect ordered item or for incorrect orders caused by user input.
- No refund will be given for personal taste preferences.
8. Food Safety and Allergy Disclaimer
- Food is prepared in compliance with applicable Singapore Food Agency (SFA) guidelines.
- Allergen information will be provided in the product specifications on the Portal for each food item.
- You must declare any dietary restrictions and exercise discretion when placing orders.
9. Health and School Compliance
- You must comply with school rules on food consumption and any approved dietary programmes, where applicable.
- We may restrict certain food items to comply with school policies.
10. Personal Data Protection
We collect, use, and process personal data in accordance with the Personal Data Protection Act 2012 (Singapore).
10.1 Data Collected
- Student name, class, and identifying information.
- Parent or guardian contact details.
- Order and payment information.
10.2 Purpose of Use
- Order fulfilment and identity verification.
- Communication with parents, guardians, and schools.
- Operational administration and service improvement.
10.3 Consent
- By registering, you consent to the collection and use of your data for the purposes stated in these Terms.
- We may share relevant data with school administration where required for operations.
11. Use of Technology (Facial Recognition)
If biometric or identification data is used, it will be handled as follows:
- It will be used solely for verification, redemption, and processing E-Wallet payment at the canteen.
- It will not be shared externally without consent, unless required by law.
12. User Responsibilities
You agree not to do any of the following:
- Submit false or misleading information.
- Abuse the ordering system, including by placing fake orders.
- Interfere with or disrupt the operation of the Portal.
- Misuse promotions, discounts, or benefits.
13. Intellectual Property
- All Portal content, including software and branding, remains our property or the property of our licensors.
- You are granted a limited, non-transferable right to access and use the Portal for personal use only.
14. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, or consequential loss, or for delays caused by school requirements or operational disruptions.
- Our total liability in relation to any affected order is limited to the value of that order.
15. Indemnity
You agree to indemnify us against claims, losses, liabilities, and expenses arising from the following:
- Your misuse of the Portal.
- Your breach of these Terms.
16. Suspension and Termination
We may suspend or terminate your account if any of the following occurs:
- You breach these Terms.
- Fraud, abuse, or misuse is detected.
- Suspension or termination is required by the school or relevant authorities.
17. Governing Law
- These Terms are governed by the laws of Singapore.
- Any dispute shall be subject to the exclusive jurisdiction of the Singapore courts.
18. Amendments
- We may update these Terms from time to time.
- Your continued use of the Portal after any update constitutes acceptance of the revised Terms.
